Liability Waiver and Assumption of Risk

This Liability Waiver and Assumption of Risk (“Waiver”) applies to my access to and use of The Little Library coworking space located at 400 Victoria Avenue, Lynchburg, Virginia, including its workspaces, common areas, stairs, furniture, equipment and amenities (“the Space”).

1. Acknowledgment and Assumption of Risk

I understand that entering and using a shared workspace involves ordinary and inherent risks, including, but not limited to:

  • Slips, trips and falls

  • Use of stairs, furniture, equipment and shared amenities

  • Accidents or injuries caused by other members, guests or third parties

  • Equipment malfunction

  • Theft, loss or damage to personal belongings

  • Building, utility or emergency-related incidents

I understand that The Little Library cannot eliminate every potential risk associated with using a shared workspace.

I voluntarily choose to enter and use the Space and knowingly accept the ordinary and inherent risks associated with that use.

2. Personal Responsibility

I am responsible for exercising reasonable care while using the Space and for promptly reporting any injury, spill, damaged equipment, unsafe condition or security concern to The Little Library.

I understand that I am responsible for determining whether I can safely use the Space, its stairs, furnishings, equipment and amenities.

In the event of an emergency, I agree to follow instructions provided by emergency personnel or representatives of The Little Library.

3. Personal Property

I am solely responsible for protecting and securing any computers, equipment, documents and other personal property I bring into the Space.

I understand that The Little Library does not provide insurance or guaranteed security for my personal property. To the fullest extent permitted by law, The Little Library and its owners, members, managers, employees, contractors, agents and representatives are not responsible for the theft, loss or damage of my personal property.

I am responsible for maintaining any insurance I consider appropriate for my personal property and business activities.

4. Release and Limitation of Liability

To the fullest extent permitted by Virginia law, I release and hold harmless The Little Library and its owners, members, managers, employees, contractors, agents and representatives from claims arising from the ordinary and inherent risks I have knowingly assumed through my voluntary use of the Space.

Nothing in this Waiver is intended to waive any right or claim that cannot lawfully be waived under Virginia law.

5. Acknowledgment

By electronically signing below, I acknowledge that:

  • I have carefully read and understand this Waiver.

  • I understand the ordinary and inherent risks associated with using the Space.

  • I voluntarily accept and assume those risks.

  • I understand that I am responsible for protecting my personal property.

  • I have had the opportunity to ask questions before accepting this Waiver.

  • I agree to this Waiver voluntarily.
